The Platform does not offer real-money gambling, and no actual monetary prizes or payouts are available. Sunset Tokens and all virtual currency have no cash value and cannot be exchanged for real money, goods, or services. Success in social casino games does not imply future success in real-money gambling.

4. Virtual Currency and Purchases

Sunset Tokens are virtual in-game currency with no real-world monetary value. Optional purchases of Sunset Tokens through subscription plans are final and non-refundable except as required by applicable law. We reserve the right to modify token pricing, subscription plans, and virtual economy parameters at any time with reasonable notice to users.

5. User Conduct and Prohibited Activities

You agree not to: use the Platform for any unlawful purpose; attempt to gain unauthorised access to any part of the Platform; use automated scripts, bots, or cheats to manipulate gameplay; harass, abuse, or harm other users; impersonate any person or entity; reverse engineer, decompile, or disassemble any part of the Platform; or interfere with the proper functioning of the Platform. Violation of these rules may result in immediate account termination.

6. Intellectual Property Rights

All content on the Platform, including but not limited to games, graphics, logos, text, software, audio, and the Sunset Retro design aesthetic, is the property of TREND SALE INC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal, non-commercial entertainment purposes only.

7. User-Generated Content

If you submit content to the Platform (such as reviews, messages, or profile information), you grant TREND SALE INC a worldwide, royalty-free, perpetual licence to use, reproduce, modify, and display such content in connection with operating and promoting the Platform. You represent that you own or have the right to submit such content and that it does not violate any third-party rights.

8. Limitation of Liability

To the maximum extent permitted by applicable law, TREND SALE INC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to us in the twelve months preceding the claim, or fifty US dollars ($50), whichever is greater.

9. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Indemnification

You agree to indemnify, defend, and hold harmless TREND SALE INC and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

11. Termination

We may suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and governing law) shall survive.

12. Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the state and federal courts located in Wilmington, New Castle County, Delaware, USA. You consent to the personal jurisdiction of such courts.

13. Changes to These Terms

We reserve the right to modify these Terms of Use at any time. Material changes will be communicated via email or a prominent notice on the Platform at least 14 days before they take effect. Your continued use of the Platform after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Platform and may delete your account.
